BURLINGTON (AP) - A Vermont man who pleaded guilty to charges he kidnapped, sexually assaulted and then killed his 12-year-old niece, avoiding a federal death penalty trial, is scheduled to be sentenced in May.

Michael Jacques of Randolph made the plea in August as part of an agreement with federal prosecutors, in which he will be sentenced to life in prison without the possibility of parole. The sentencing hearing has been scheduled for May 20 in U.S. District Court in Burlington.

Prosecutors had been planning to seek the death penalty against the 47-year-old Jacques on charges of kidnapping with death resulting.

Brooke Bennett disappeared in June 2008. Her body was found about a week later not far from Jacques' home.
