• A Brattleboro man who is currently incarcerated at Marble Valley Regional Correctional Center in Rutland was recently cited with disorderly conduct and assaulting a corrections officer after an incident at the prison on Aug. 25.
According to a press release from the Vermont State Police, Herbert E. Fagans III was yelling obscenities at the nursing staff inside the correctional center when corrections officers intervened. Fagans, who failed to comply with the officers' requests, took a hostile stance and faked a charge at one of the corrections officers before being sprayed with pepper spray.
Fagans then ran at the two guards, swinging his arms and striking one in the face, grabbing his neck and scratching him. After Fagans was subdued, he was screened by medical staff and placed in high security. Inmate Fagans is charged with assaulting a correctional staff and disorderly conduct.
