BRATTLEBORO -- A Bellows Falls man who was scheduled to go on trial Tuesday for second-degree aggravated domestic assault instead took a plea agreement Tuesday morning.
Thomas Supernois, 38, was arrested July 1 at a residence on Henry Street Extension in Bellows Falls and has a lengthy prior criminal history.
"An agreement couldn’t be reached on sentencing, so the court will sentence the defendant after a contested hearing," said Deputy State’s Attorney David Gartenstein.
The hearing is scheduled for Jan. 12 and will come after the completion of a pre-sentence investigation, ordered by Judge Karen R. Carroll Tuesday. Supernois is being held without bail until sentencing.
Even with the aggravated domestic assault charge having been amended down to domestic assault as a part of the plea agreement, Supernois is facing a maximum sentence of 44 months total for four separate charges, which include resisting arrest, simple assault and disorderly conduct.
"The defendant acknowledged assaulting a household member. He also admitted assaulting an acquaintance who intervened," Gartenstein said.
As part of the plea agreement, two additional charges of domestic assault were dropped.
When the severity of the charge was amended down, the maximum penalty on the domestic assault charge was decreased from five years in prison to 18 months.

One police officer tackled Supernois to the ground and ordered him to put his hands behind his back, but he did not comply and ultimately police stunned him with a Taser in order to subdue him.
A woman at the scene told police after the incident that Supernois had also struck her in the face, and a man who tried to break up the fight by putting Supernois in a headlock said that he let Supernois go once he became calm, but after starting to walk away Supernois came back and kicked him in the back and punched him in the face.
Supernois has several other convictions in Windham County including one for domestic assault in 2004 for which he was sentenced to nine to 12 months in prison.
He also has a criminal record in Waterbury, Springfield, and Westmoreland, N.H.
